Department of Education Releases FAQ on IDEA and Parentally Placed Children in Private Schools

 

Last week, the Department of Education released a collection of frequently asked questions regarding the obligation states and local education agencies have when providing special education services to parentally placed private school students with disabilities, under the Individuals with Disabilities Education Act 2004 (IDEA).  A change from the previous version of IDEA enacted in 1997, IDEA 2004 contains a provision that requires the LEA to complete a child find process for those students with disabilities attending private schools in the LEA’s jurisdiction.

Included in the FAQ are questions such as:

  • What is consultation and what must the consultation process include with private school representatives and representatives of parents of parentally places private school children with disabilities?
  • Which LEA is responsible for conducting child find for parentally placed private school children?
  • What specific child find count information must the LEA maintain and report to the SEA?
  • What is the process for making decisions with respect to the services to be provided to eligible parentally placed private school children with disabilities?
  • Do the child find and equitable participation requirements apply to children with disabilities, aged 3 through 5, enrolled by their parents in private elementary schools?
  • Who is responsible for determining and paying for services provided to out-of-state parentally placed private school children with disabilities?
  • Are home schooled children considered parentally placed private school children?
